WHAT A NOTARY PUBLIC CANNOT DO
As a Nevada Notary Public, I cannot:
- Provide legal advice or tax advice;
- Tell you which legal document you need;
- Select a legal document for you based upon your individual circumstances;
- Draft or modify a legal document for you unless separately authorized by applicable Nevada law;
- Interpret the provisions or legal meaning of your document;
- Explain the legal consequences of signing a document;
- Recommend a particular legal strategy;
- Tell you whether a document adequately protects your interests;
- Determine whether a contract, agreement, will, trust, power of attorney, or other legal instrument is appropriate for your circumstances;
- Represent you in a legal matter;
- Give an opinion regarding your legal rights or obligations; or
- Encourage you to enter into or decline a transaction involving a notarial act.
If you need legal advice, you should consult an attorney licensed to practice in the appropriate jurisdiction.
NEVADA UNAUTHORIZED PRACTICE OF LAW
Nevada law restricts the practice of law to persons authorized to practice law.
NRS 7.285 addresses the unauthorized practice of law and provides restrictions concerning persons who are not authorized to practice law in Nevada.
Accordingly, my notarial services are intentionally limited to the performance of lawful notarial acts. I do not hold myself out as your attorney, legal representative, or legal advisor.
Nevada law also regulates document-preparation services under NRS Chapter 240A. Nevada's document-preparation laws impose restrictions concerning legal advice, legal opinions, recommendations concerning legal rights or remedies, selection of legal documents, and legal strategies.
Nothing contained in my notary services, website, advertising, communications, or business materials should be interpreted as an offer to provide legal representation or unauthorized legal services.
NOTARY IMPARTIALITY
Under NRS 240.075, a Nevada Notary Public may not, among other prohibited conduct:
- Influence a person to enter into or decline a lawful transaction involving a notarial act;
- Perform a notarial act with intent to deceive or defraud; or
- Endorse or promote a product, service, or offering when the Notary's appointment as a Notary Public is used in the endorsement or promotional statement.
